8 NGOs yêu cầu TT Obama thúc đẩy thả Ls LQQ trước cuộc hội kiến

Thưa ông Tổng Thống,

Các tổ chức ký tên dưới đây trân trọng yêu cầu Ông nêu vấn đề với nhà cầm quyền Việt Nam về việc bắt giữ và giam cầm tùy tiện ông Lê Quốc Quân, một luật sư, blogger và nhà đấu tranh nhân quyền nổi bật. Chúng tôi được biết ông Trương Tấn Sang, Chủ tịch nước Việt Nam sẽ hội kiến ông vào ngày 25 tháng 7, 2013, và chúng tôi thành khẩn mong Ông dùng cơ hội này để trao đổi về trường hợp của Lê Quốc Quân.


Ông Quân là một luật sư đủ tư cách và là một blogger năng nổ hiện đang bị giam cầm vì đã thực thi quyền tự do ngôn luận, tự do hội họp và lập hội ôn hòa, và vì các hoạt động tranh đấu nhân quyền của ông. Trước khi bị bắt, trên trang blog nổi tiếng của mình, ông đã phơi bày các vụ vi phạm nhân quyền mà các cơ quan truyền thông của Nhà nước Việt Nam thường phớt lờ. Trước khi bị tịch thu giấy phép hành nghề luật sư năm 2007, ông Quân đã bào chữa các vụ án nhân quyền tại tòa; ông đã bị bắt giam trong 100 ngày khi ông trở về Việt Nam năm 2007 sau chuyến đi Hoa Kỳ, tại đó ông từng là một cựu nghiên cứu sinh của chương trình Reagan-Fascell tại Học viện Quốc gia Hỗ trợ Dân chủ (National Endowment for Democracy). Vào tháng 4 năm 2011, ông bị bắt giữ một lần nữa và sau đó được trả tự do mà không bị buộc tội. Vào tháng 8 năm 2012, ông Quân bị đả thương nghiêm trọng trong một vụ hành hung mà ông nghi là do bàn nhân viên Nhà nước.

Ngày 27 tháng 12 năm 2012, ông Quân lại bị bắt và bị buộc tội “trốn thuế”. Ông đã bị biệt giam trong vòng hai tháng đầu tiên và tuyệt thực 15 ngày. Ngay lúc này ông Quân vẫn đang bị giam cầm và không được phép gặp gia đình. Phiên xử dự kiến diễn ra vào ngày 9 tháng 7, 2013, nhưng đã bị hoãn vào giờ chót mà chưa được thông báo ngày xử mới.

Việc bắt và giam giữ ông Quân vi phạm những cam kết quốc tế, đặc biệt ở điều khoản 19, 21 và 22 của Công Ước Quốc Tế về Các Quyền Dân Sự và Chính Trị. Các điều khoản này buộc nhà nước có nhiệm vụ phải bảo vệ quyền tự do ngôn luận, hội họp và lập hội của ông Quân. Cách đối xử với ông cũng đi ngược lại nhiệm vụ của nhà nước phải bảo đảm và bảo vệ các quyền hạn của người hoạt động nhân quyền, như đã liệt kê trong bản Tuyên Ngôn của Liên Hiệp Quốc về Những Nhà Bảo Vệ Nhân Quyền. Nhiều thông tin chi tiết hơn về ông Lê Quốc Quân và sự can thiệp bất hợp pháp đối với các quyền con người của ông được trình bày trong bức Thư Tố Cáo kèm theo đây, bức thư gần đây đã được gởi đến những Báo Cáo Viên Đặc Biệt của Liên Hiệp Quốc.
                                                                                                                  
Vì tầm quan trọng to lớn của sự chú ý của thế giới về nỗ lực đem lại tự do cho ông Quân cũng như giúp cho ông được trở lại với các hoạt động nhân quyền cần thiết, chúng tôi hy vọng Ông nắm bắt cơ hội qua cuộc viếng thăm của Chủ tịch Sang sắp tới để yêu cầu ông Quân được thả ngay lập tức.

Dear Mr President,

The signatory organisations respectfully request that you raise with the Vietnamese Government the arrest and arbitrary detention of Mr Le Quoc Quan, prominent lawyer, blogger and human rights defender. We understand that President Truong Tan Sang of Vietnam will meet with you on 25 July 2013 and we sincerely hope that you will take this opportunity to discuss Mr Quan’s case with him.

Mr Quan is a qualified lawyer and active blogger who is currently detained for exercising his rights to freedom of expression, association, and peaceful assembly, and for his activities as a human rights defender. Prior to his arrest, Mr Quan exposed human rights abuses commonly ignored by Vietnamese state media on his popular blog. He defended human rights cases in the Vietnamese courts until he was disbarred in 2007, when he was arrested and detained for 100 days upon his return from the United States where he had been a Reagan-Fascell Democracy Fellow at the National Endowment for Democracy in Washington, D.C. In April 2011, Mr Quan was arrested again and ultimately released without charges. In August 2012, he was severely injured in a violent attack committed by what he believes were State agents.

On 27        December 2012, Mr Quan was arrested and charged with alleged ‘tax evasion.’ He was detained incommunicado for the first two months and went on hunger strike for fifteen days. At this moment, Mr Quan is still imprisoned and is not allowed visits from his family. His trial was scheduled to take place on 9 July        2013, but was postponed at the last moment until further notice.

Mr Quan’s arrest and detention are in violation of Vietnam’s obligations under international law, in particular Articles 19, 21 and 22 of the International Covenant on Civil and Political Rights, which impose duties on the government to protect Mr Quan’s rights to freedom of expression, association and peaceful assembly. His treatment also contravenes state duties set out in the UN Declaration on Human Rights Defenders, to ensure and protect the rights of human rights defenders. More detailed information about Mr Quan and Vietnam’s unlawful interference with his human rights is set forth in the attached Letter of Allegation recently sent to the Special Rapporteurs of the United Nations.
                                                                                                                  
Given the great importance of international attention to the effort to secure Mr Quan’s freedom, and to enable him to return to his indispensable human rights work, we hope you will seize the opportunity of President Sang’s upcoming visit to request the immediate release of Mr Quan.
